US Fish and Wildlife Service Expands Shellfish Definition to Include Squid, Octopus and Cuttlefish

SeafoodNews by Ryan Doyle - July 1, 2026

The US Fish and Wildlife Service has finalized a rule updating the regulatory definition of "shellfish" to include cephalopods — squid, octopus, and cuttlefish — bringing federal regulations in line with modern scientific understanding and longstanding commercial practice.

Under 50 CFR Part 10, the FWS regulates the import and export of wildlife and wildlife products, with certain exemptions for shellfish. The revision extends that exemption to cephalopods, which were previously excluded despite being treated as conventional seafood products across commercial markets.

The update was developed in coordination with NOAA to ensure consistency across federal agencies. The FWS said the change will ensure commercially harvested squid fisheries are treated the same as other seafood products under current import and export rules, reducing regulatory requirements and associated costs for producers, processors, importers, and exporters.

"America's seafood industry operates in a global marketplace, and our regulations should reflect modern science and common sense," said FWS Director Brian Nesvik. "This update removes an unnecessary regulatory burden on US squid fisheries, provides greater certainty for seafood producers and exporters, and aligns our regulations with longstanding commercial and international practice."

The FWS noted the rule does not alter existing conservation authorities, wildlife protections, or management responsibilities.

Here’s the full notice that was published in the Federal Register.
