Ninth Circuit Rejects Oceana's Gulf of Alaska Seafloor Habitat Challenge, Finding No Legal Standing

The US Ninth Circuit Court of Appeals has ruled against Oceana's challenge to federal management of seafloor habitats in the Gulf of Alaska, finding the conservation group lacked the legal standing necessary to pursue its claims.
In a ruling issued last Thursday in Anchorage, a three-judge panel found that Oceana, represented by Earthjustice, "failed to show that any injury to the organization's members is traceable to the challenged [NMFS management plan] amendments."
As one example, the court rejected Oceana's contention that, if required to redo its analyses, the National Marine Fisheries Service (NMFS) would identify more essential fish habitat adversely affected by fishing — calling that argument "pure conjecture."
Oceana had argued that NMFS and the North Pacific Fishery Management Council entirely ignored the effects of bottom trawling on known essential fish habitats and underrepresented impacts elsewhere, in violation of the Magnuson-Stevens Fishery Conservation and Management Act.
The US District Court in Alaska dismissed the underlying lawsuit in 2025, largely deferring to the federal agency, prompting Oceana's appeal to the Ninth Circuit.
The appeals court also found that Oceana "failed to demonstrate that its members' alleged injuries are redressable," characterizing its legal theory as "too attenuated and contain[ing] too many links consisting of unsupported conjecture."
"We vacate and remand for lack of Article III jurisdiction," the panel wrote — effectively ending the challenge on procedural grounds without addressing the substance of Oceana's environmental claims.
